Last Will and Testament of Thomas Outten

1725-6. Maryland, Summersett County. In the name of God, Amen. Thomas Outten of the county and province above mentioned being very sick in body but of perfect memory and for the settling of my temporal estate and knowing the uncertainty of this transitory life, in the first I do commit my soul to God that gave it and my body to the earth to be decently buried and I hope to be saved through the merits of the Savior, the Lord Jesus Christ, and at the day of resurrection rise to life eternal and this my last will and testament and bequeath my temporal estates followeth:

Imprims: I give and bequeath unto William Selby a small parcel of marsh land and trees thereon, beginning at a mulberry set up in the marsh at the mouth of a Gutt or water course till it comes to the line dividing between the tract of land called Simpaltum and the land of William Selby and running along the said small parcel of marsh and land to William Selby and his heirs.

Secondly: My will is that my beloved wife shall peaceably enjoy my housing and plantation and land bequeathed to me by my father all wholly fully during her widowhood and if in case she marry then to enjoy half of the aforesaid housing and land and plantations and I also give and bequeath to my well beloved wife the third part of moveable estate to my loving wife.

Thirdly: I give and devise to my son, Thomas Outten, my plantation I now dwell on with all the land appertaining and belonging to it bequeathed to my by my father John Outten's last will and testament to him and his heirs forever wholly to be possessed by him when after his mother's decease.

Fourthly: I give and bequeath 3 cows and calves to my son Samuel Outten to be delivered to him when he comes to age.

Fifthly: I give and bequeath to all the remaining part of my personal estate to my children: namely John Outten, Thomas Outten, Samuel Outten, Elizabeth Outten and Abraham Outten, to be equally divided amongst them.

I do nominate and appoint my loving wife to be my executrix to see this my will performed and have hereto set my hand and seal the 3rd day of January 1725 in sight and presence of on

At the foot of the forgoing will, was thus written: November ye 19, 1726 Then came George Turitt, Abraham Outten and Saml Truitt subscribing evidence to the within will, who made oath upon the Holy Evangel, of Almighty God that they saw the within named Thomas Outten, the testator, sign and seal the within instrument as his last will and testament and that they heard him publish and declare the same to be and that at the time of his so doing was of sound disposing mind and memory to the best of their knowledge,
